WHAT IS TRANSVAGINAL MESH?

Transvaginal mesh is a medical device primarily utilized in women to repair or stabilize weakened or damaged pelvic tissue that causes pelvic organ prolapse (POP) or stress urinary incontinence (SUI). These devices are surgically implanted in the pelvic floor region of women suffering from SUI or POP to support organs such as the bladder, uterus, and rectum that may have sagged or been displaced due to childbirth, menopause, or surgery.

ISSUES RELATED TO TRANSVAGINAL MESH

Although these devices were designed to provide a permanent solution for women suffering from these common pelvic floor conditions, the use of transvaginal mesh has led to significant medical debates and health concerns. This is because many of these transvaginal mesh devices were inadequately tested and/or improperly designed. One of the primary concerns is mesh erosion, which happens when the device’s mesh wears through the vaginal wall or other surrounding tissues, causing pain, discomfort, and recurrent urinary tract and more severe pelvic infections.  Another concern is the fact that many of these devices are non-biocompatible, meaning that the materials used to manufacture the transvaginal mesh products are not compatible with living tissue and, therefore, increase the chance for injury, complication, and need for removal of the device.

In addition, patients may experience pain during sexual intercourse, which is a condition known as dyspareunia. This can strain personal relationships and lead to emotional and familial distress. Other reported issues associated with transvaginal mesh products include but are not limited to vaginal bleeding, vaginal scarring (which can lead to decreased vaginal elasticity and mobility), and mesh contraction (which can cause severe pelvic pain and urinary problems, among others).

Additionally, mesh migration is another complication associated with transvaginal mesh devices. Migration occurs when the mesh moves from its original implant position and compromises the integrity of pelvic organ support. This generally leads to recurrent prolapse of the organs that the mesh device was initially intended to support.

These mesh-related issues and complications often necessitate additional medical interventions, including surgeries to remove or adjust the mesh, and can significantly deteriorate the overall well-being of the injured patient and their loved ones. If you or a loved one is experiencing any of these harmful impacts, seeking compensation with the help of a knowledgeable products liability lawyer can be a critical step toward medical, psychological, and financial recovery and support.

For over a decade, thousands of women across the country have filed vaginal mesh lawsuits related to the substantial harm they suffered as a result of having a mesh product implanted to treat SUI or POP.

MEDICAL MALPRACTICE OR TRANSVAGINAL MESH PRODUCT LIABILITY

If your surgeon implanted the device incorrectly, you might have a medical malpractice claim. However, most complications from these cases are more associated with the defective faulty product vs what the doctor did.  For example, one of the main components of the mesh product is polypropylene, which is a plastic substance that doesn’t integrate well with the human body.

TRANSVAGINAL MESH LAWSUITS

Transvaginal Mesh Lawsuits are filed by women who have experienced complications due to transvaginal mesh implants.

These lawsuits focus on holding manufacturers accountable for the substantial injuries caused by their defective and harmful products.  The attorneys attempt to obtain significant compensation for the females damaged by the manufacturer’s faulty product.

In these proceedings, affected individuals seek compensation for various damages, including medical expenses, emotional distress, pain and suffering, and lost wages.

In general, most of these lawsuits allege that the manufacturers intentionally misled the U.S. Food and Drug Administration, the medical community, patients, and the public about the true dangers, safety or effectiveness of the transvaginal mesh devices. Additionally, these lawsuits allege that the manufacturers failed to adequately test and design the transvaginal mesh devices, failed to create safe and effective methods to remove the transvaginal mesh products, and failed to warn patients and healthcare providers about the risks associated with transvaginal mesh implants.

Many transvaginal mesh lawsuits were previously consolidated into multidistrict litigations based on the specific type/brand of vaginal mesh used in the device, and most of those cases have already settled or been resolved.

Despite these lawsuits being largely resolved, new transvaginal mesh lawsuits can be filed. Current transvaginal mesh lawsuits are now typically being filed in state courts and other jurisdictions.
